These Terms of Service govern your access to and use of the Radiology Experts website and services. By using our services, you agree to be bound by these terms. Please read them carefully.

Acceptance of Terms
By accessing or using the Radiology Experts website (radiologyexperts.ca), patient portal, or any related services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, and all applicable laws and regulations.
If you do not agree with any part of these Terms, you must not access or use our Services. If you are accessing our Services on behalf of a patient in your capacity as a healthcare provider, you represent that you have the authority to agree to these Terms on behalf of yourself and your practice.
These Terms constitute a legally binding agreement between you ("you" or "User") and Radiology Experts ("we," "us," or "our"), a radiology consultation service operating under the laws of the Province of Ontario, Canada.
Description of Services
Radiology Experts provides the following services through its platform:
- Second Opinion Reviews: Independent review of medical imaging studies (including but not limited to CT, MRI, X-ray, and ultrasound) by fellowship-trained, subspecialty radiologists. Reviews result in a comprehensive written report delivered to the referring physician.
- Virtual Consultations: Live 20-minute virtual review sessions where a radiologist walks the patient and/or physician through imaging findings, answers questions, and provides clinical context.
- Report Delivery: Secure delivery of second opinion reports to referring physicians via encrypted channels. Reports are designed to support, not replace, the clinical judgment of the referring care team.
- Secure Image Upload: A secure portal for patients and physicians to upload medical imaging files (DICOM format) for review, with end-to-end encryption and Canadian data residency.
Eligibility
To use our Services, you must:
- Be at least 18 years of age, or have a parent or legal guardian who consents to these Terms on your behalf
- Have the legal capacity to enter into a binding agreement
- Provide accurate, current, and complete information as required during the registration or submission process
OHIP Coverage Requirements
OHIP-insured second opinion services are available to patients who hold a valid Ontario Health Insurance Plan (OHIP) card and have a valid referral from an Ontario-licensed physician. Patients outside Ontario may access our services on a fee-for-service basis. International patients may be subject to additional eligibility requirements.
User Accounts & Responsibilities
When using our Services, you agree to:
- Provide accurate, truthful, and complete information in all submissions, forms, and communications
- Maintain the confidentiality of any account credentials and promptly notify us of any unauthorized access or use of your account
- Use the Services only for lawful purposes and in accordance with these Terms
- Not attempt to gain unauthorized access to any portion of the Services, other accounts, computer systems, or networks connected to the Services
- Not upload, transmit, or distribute any malicious code, viruses, or harmful content
- Not use the Services to infringe upon the rights of others or to engage in any activity that is unlawful, deceptive, or harmful
You are responsible for all activities that occur under your account or through your use of the Services.
Medical Disclaimer
Important Notice
The Services provided by Radiology Experts are intended to supplement, not replace, the relationship between a patient and their primary healthcare provider. Our second opinion reports are advisory in nature and should be reviewed and interpreted in the context of the patient's complete clinical picture by a qualified physician.
- Not a Substitute for Primary Care: Our services do not constitute a physician-patient relationship. A second opinion is an independent assessment intended to inform clinical decision-making by the referring physician. It does not replace the need for an in-person examination, clinical assessment, or ongoing care.
- Educational Purpose: Virtual review sessions are intended to help patients and physicians understand imaging findings. They are not a substitute for a comprehensive medical consultation.
- Not for Emergencies: Our Services are not designed for emergency or time-critical situations. If you are experiencing a medical emergency, call 911 or go to your nearest emergency department immediately. Do not rely on our services for urgent clinical decisions.
- Limitations of Imaging Review: Radiology interpretation is inherently subject to variability. A second opinion may agree with, supplement, or differ from the original interpretation. Patients and physicians should consider all available clinical information when making treatment decisions.
Intellectual Property
All content, features, and functionality of the Services, including but not limited to text, graphics, logos, trademarks, service marks, icons, images, software, and design elements, are the exclusive property of Radiology Experts or its licensors and are protected by Canadian and international intellectual property laws.
You may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, or transmit any materials from our Services without our prior written consent, except as follows:
- Your browser may temporarily store copies of pages for display purposes
- You may print or download one copy of a reasonable number of pages for personal, non-commercial use
- Second opinion reports delivered to you are provided for your personal medical use and may be shared with your healthcare providers
Payment & Pricing
Ontario Residents (OHIP)
Free
Second opinion reviews for Ontario patients with valid OHIP coverage and a physician referral are covered at no cost to the patient. Services are billed directly through OHIP.
Non-Ontario / Private Pay
$600
Per second opinion review or virtual consultation session. This fee applies to patients outside Ontario, uninsured patients, and virtual review sessions.
- All prices are quoted in Canadian dollars (CAD) and include applicable taxes unless otherwise stated.
- Payment is required prior to the commencement of non-OHIP-covered services and may be made by credit card, debit card, or electronic transfer through our secure payment processor.
- Refund Policy: If a review cannot be completed due to insufficient or unsuitable imaging data, a full refund will be issued. Once a report has been delivered, refunds are not available, as the radiologist's professional services have been rendered. In exceptional circumstances, partial refunds may be considered at our sole discretion.
- We reserve the right to modify pricing at any time. Price changes will not affect services already purchased or in progress at the time of the change.
Privacy & Confidentiality
Your privacy is fundamental to our services. The collection, use, and disclosure of your personal and health information is governed by our Privacy Policy, which is incorporated into these Terms by reference.
By using our Services, you consent to the collection, use, and disclosure of your information as described in the Privacy Policy. We are committed to complying with PIPEDA, PHIPA, and all applicable Canadian privacy legislation in the handling of your personal health information.
All radiology reports, communications, and clinical information exchanged through our platform are treated as confidential and subject to the same protections afforded to medical records under Ontario law.
Limitation of Liability
To the fullest extent permitted by applicable law:
- Radiology Experts, its directors, officers, employees, consultants, radiologists, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or related to your use of or inability to use the Services.
- Our aggregate liability for any claims arising out of or related to the Services shall not exceed the total amount paid by you to Radiology Experts for the specific service giving rise to the claim during the twelve (12) months preceding the date of the claim.
- Nothing in these Terms shall exclude or limit liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by law.
The Services are provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the accuracy, completeness, or reliability of any second opinion report or the availability or uninterrupted operation of the Services.
Indemnification
You agree to indemnify, defend, and hold harmless Radiology Experts and its directors, officers, employees, consultants, radiologists, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:
- Your use of or access to the Services
- Your violation of these Terms
- Your violation of any applicable law, regulation, or third-party right
- Any content or information you submit through the Services that is inaccurate, incomplete, or misleading
This indemnification obligation shall survive the termination of these Terms and your use of the Services.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.
Any legal action or proceeding arising out of or related to these Terms or the Services shall be brought exclusively in the courts of the Province of Ontario, Canada, and you irrevocably consent to the jurisdiction of such courts.
Dispute Resolution
In the event of any dispute, claim, or controversy arising out of or related to these Terms or the Services, the parties agree to the following resolution process:
- Informal Resolution: The parties shall first attempt to resolve the dispute informally by contacting our administrative team. We will make reasonable efforts to address your concerns within 30 business days.
- Mediation: If informal resolution is unsuccessful, the parties agree to attempt mediation administered by a mutually agreed-upon mediator in the Province of Ontario before pursuing any other form of dispute resolution.
- Litigation: If mediation is unsuccessful, either party may commence legal proceedings in the courts of the Province of Ontario in accordance with the Governing Law provisions of these Terms.
Nothing in this section shall prevent either party from seeking injunctive or other equitable relief from a court of competent jurisdiction where necessary to prevent irreparable harm.
Modifications to Terms
We reserve the right to modify, amend, or replace these Terms at any time at our sole discretion. When we make material changes, we will:
- Update the "Last updated" date at the top of this page
- Provide notice to registered users by email or through a prominent notice on our website
- Allow a reasonable period for review before the changes take effect
Your continued use of the Services after the effective date of any modifications constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must discontinue your use of the Services.
